Hi Anil,
I am currently working on the STEM OPT EAD which will expire on the 01-03-2024. My spouse is applying the H1b extension under premium processing ( with approved I-140).
We requested the them to file COS to H4 and along with H4 EAD with H1B application,
They are saying we can’t apply the H4 EAD because the current STEMOPT EAD not expiring with in 180 days period of filing.
I am confused why can’t we file the H4 EAD now, could you please advise?
As per my knowledge both are two different types of EAD’s but I am not sure the rule belongs to all EAD’s or only for renewal of same kind of EAD.
Please advise.
