Regarding H4 Auto extension

Hi Kalpesh,
I believe my spouse is eligible for H4 EAD auto extension as per below steps and current H4 EAD is going to expire on March 05, 2022. Please have a look below steps and confirm.

  1. Entered into USA on January 19, 2020 with H4 status (Visa is valid until March 05, 2022)
  2. Got I94 at port of entry until September 10, 2020 which is passport expired date . But valid H4 visa until March 05, 2022.
  3. Applied H4 extension in August 09, 2020 with new renewal passport.
  4. Spouse changed employer in July 22, 2021 and applied H1B, H4 and H4 EAD concurrent processing
  5. Spouse H1B got approved upto August ,2024 on July 30, 2021 in premium processing . But H4 and H4 EAD are in Received status
  6. H4 got approved until August 2024 which we applied due to passport expired (point # 3)
  7. Applied another H4 EAD standalone in September 09, 2021 ( with hope H4 EAD standalone process time taken very less)

I believe , the above scenarios is eligible for H4 EAD auto extension (180 days) Since we have approved H4 with I94 valid until August 2024 and applied standalone H4 EAD .

Yes, you should be eligible for auto-extension for up to 180 days from expiry of your current EAD.
