Intent to deny notice - h4 ead

Here is the case history of my spouse-

  1. August 2018: Applied for Change of Status (form-I539) from L1 A to H4.

  2. October 2018: Traveled to India and Change of status became invalid.

  3. November 7, 2018: H4 Visa stamping completed in US consulate Chennai, India

  4. November 28, 2018: Arrived back in the US, using H4 dependent visa

  5. December 2018: Applied for H4 EAD (FORM I765).

  6. April 2019: Received “Intent to Deny” stating we should demonstrate his valid H4 non-immigrant status.

What documents we have to provide to USCIS to prove that my spouse is on valid H4?
Once we provide the documents to USCIS, how long it will take to get H4 EAD approval?

When you applied for H4 EAD in December, what H4 status proof did you send with your application?

Didn’t you send the H4 i94 that you received on Nov 28, 2018?

Thank you for getting back to me. Yes, we did provide the latest I-94 and also the passport copy with H4 stamping page.

Not sure why we received NOID.

I think its because of the H4 COS status application which was filed before your spouse left US.

You can submit the proof of H4 status again:

  1. H4 most recent i94
  2. H4 visa stamp
