Hi im in the philippines and is scheduled for h4 visa interview on april 1, 2021 while my wife which is in the US has her h1b visa expiring on april 30, 2021. Her employer is currently processing her h1b extension but has no clear timeline when it will be processed. Will it be an issue during my interview if her h1b extension is not yet processed? or if it will be processed, can i just provide documents on her h1b extension application? thanks in advance
No issue but the VO may only issue the visa up to 30th April ( till your spouse’s H1B validity) and you will need to travel before the visa expiry. This short validity of visa may not be helpful and could just be waste of time and money.
You need copy of primary H1B approved petition for H4 visa stamping. Just tell her to request her employer to upgrade the extension of status application to premium processing. Then carry the copy of I797 approved notice to your interview so that you can get visa with 3 years validity.
