H4 RFE from new employer petition

Hi, Last year a prospective employer filed my h1b transfer and h4 extension for dependents. I ended up (due to an acquisition) with my current employer and my h1b and h4 extensions were approved (current employer petitions) last year.

Now I received an RFE (for the application from that prospective employer) for my son asking for birth certificate, He already has h4 extension approved till 2024. I am wondering if I need to respond to the RFE or ask that employer to withdraw the application.

I will appreciate any comment on this.

First of all, H4 application is not employer sponsored so your employer can’t withdraw. Just let the prospective employer know that you won’t be joining so they can withdraw the H1B. Once that is done, the H4 applications will be denied automatically.
