My H1B extension recently approved on Nov 03,2020 and biometric for my dependents H4 extension completed on 11/27, but not received the approval yet. Last i94 is already expired for all of us on 20 Nov 2020.
I am changing my employer now and the transfer process just initiated, it may take around 4 more weeks to submit the transfer petition.
My wife has to travel for an emergency to India… but the attorney who files the transfer clearly mention that the dependents must the in US while submitting the transfer.
Can someone suggest me what to do in this situation?
Is it possible to apply for h4 transfer just for kids without spouse and let her travel?
