Hi, My spouse’s H4 and H4 EAD are still pending. We have filed for RN Litigation in October, RN law firm had responded to USCIS query and the response is due Feb 5th. Did any of you guys know if H4 and H4 EAD is not yet approved because USCIS is challenging the petition?
Also, our case was applied in Aug 2019 to Vermont Service Center and the timeline is around 6 months

Lot of people are facing the same issue and many people have not got the approval even after filing the litigation.
Did you speak to RN law about what can be done next?
RN law firm got an response from USCIS that USCIS is challenging the case and RN LAW firm will be appearing in court in Feb last week. They say that the cases still get approved during this process.

I agree. The USCIS challenge won’t affect your case. So, no need to worry.
Your H4 EAD can get approved anytime.
