I have an approved I-140 from Employer A almost 2 years back. Later, I moved to Employer B - When they filed for my H1B transfer - I got my H1B validity till March 2022. By March 2022 I will be completing 5years and 6 months of total H1B (from both Employer A and Employer B).
So my question would be, as my current employer (Employer B) is not promising about initiating a green card process anytime soon, can I use the approved I-140 document from Employer A to file for my H1B extension (beyond 5years and 6 months)? If that’s possible - I can think of a couple of possible outcomes - Could you please let me know what might be the best fit for my scenario ?
- Will I get just 6 months of H1B validity till October 2022?
- Or do I get 3 more years of H1B validity till March 2025?
- If not, what are the alternatives to extend my H1B validity?
