H1b client change when extension with current client is going on. Employer is same

(P) #1

If my current extension is in process and now my employer want me to move to some other client.
that is another extension/ amendment required.
How this works and is it safe in this environment .

I am just on H1B, nothing started for GC yet.

Well, safety is relative with H1B approvals.

Remember, each extension or amendment or transfer is now evaluated as a new H1B application by USCIS.

It all depends on paperwork that you submit.

yeah that is true.
paperwork is key anyways.
I was concerned if one is already in progress, sometimes people say wait for it to complete then file new. but my manager is not willing to wait for this opportunity :stuck_out_tongue:

There is higher risk involved if your i94 has already expired and you try to file another amendment or extension.

If your current i94 is valid, then you don’t have much risk, as per my opinion.
If the amendment is denied in this case, you can come back to the other extension (if it’s still valid) and keep working.
