As far as I know I think he still had few days left on his h1 before he could apply for his h1b. But even if thats not the case, he might have gotten lucky which can happen to a few…

What if H4 application is approved and new employer files a H1 transfer petition. Will be still require consular processing ?
@GDvisa Were you able to re-enter US with a new I-94 based on the new I-797B?
