I was on H1 B intially and i moved to H4-EAD when i had almost 21 days left on my H1B for 6 years to max out and i have never changed my employer during this period. My current employer may not file for PERM when on H4 EAD as per the policy. Can i move to another employer and have my PERM filed and when after my I140 approval, can the 21 days be captured to change my status from h4 to h1 and henceforth get 3 years extension based on my approved I140.
