Hello Anil,
My spouse is currently on F1 Visa working. She would like to take a sick leave and stay at home ?
I have H1b with approved I-140, Can she apply for H4 COS and H4 EAD concurrently?
When can she stop working in this scenario ?
would we violate OPT 60 day unemployment rule if she stops working during the COS application processing ?
Just a follow up on I-539 Q 19. should we list all her previous employers or just the current employer?

Apply H4 COS and H4 EAD together
You can apply F1 to H4 COS and H4 EAD together.
F1 to H4 COS
Your wife’s F1 status will remain F1 until USCIS approves H4 status.
She has to maintain her F1 status until she gets H4 approval.

Thank you! She changed employers so on OPT, For I -539 the supplement form Part 4 do we need to list all her employers or just the current one?

You have to mention all the employment that she has taken up since her LAST entry in USA.

Hi Anil,
Thank you so much. Just one more doubt I have while filling i-539 form for my wife. Part 3. 1.a I/We request the my/our current or requested status be extended until - My (principal) H1B expiration date. is that correct ?

H4 can only request time upto H1B validity.
