Dependents H4 rejected, should I send them back

Hi Admin,

My dependents H4 - i94 expired on Sept-2018 and I applied late on Nov-2018 under Nunc pro tunc processing. Now USCIS says its rejected after 8 months. Actually, my H1-B is also long pending, not approved yet. Should I send them back to India and get them back after my H1-B is approved?

Thanks,
Noor.

Yes, if the H4 extension has been denied, H4 should leave US as early as possible.

Thanks. Can they come back? Or will they be barred for 3 years as its been 8 months since i94 expired?

That’s tricky. They will need to apply for H4 visa and then anything can be said.
